I got rear-ended at a light.I had a PI attorney since day 1. I went to the chiropractor 3 times a week for 4 months. (also went to MRI, Orthopedist etc..) On the final report it says I have 5-6 % permanent damages. Also says i got bulged disks in the neck.
Just myy medical bills total about $12000.00 and the insurance made an offer of $8000.00
Should i take it or got to court?
Anyone had similar experience or any lawyer??
Oh and i Forgot. Im in Florida which is a no-fault state, so my own insurance company is paying for 80% of all Medical bills UP to $10.000 so there is about $3200-3500 that remains unpaid. So i have to deduct that from $8000.00 plus attorney’s fees which are 33.3%
So there is about $1850.00 left

take it to court if you have a good lawyer than he can probably get you much more money than that

Never take the first offer. 9 times out of 10 they will offer more to keep it out of court.

out of that 8000.00 are they paying your medical bills or do you have to pay them well I had a simular case like this and i only got 10,000.00 which the lawyer gets like a 33.3 percent of that off the top so you might end up with 5000.00 but i would take it to an aubutration first before the court cause it’s not true the longer you wait the more they offer cause my case went on for 4 years and you will really get tired of waiting trust me and think about it a judge is going to listen to both sides of the case and make his judgement and he could offer you less then what they do… And after court you can appeal it but it takes so long to wait for another date and they can denie your appeal so if I was you I would have my lawyer tell them the lowest number you will go and then if they go for it take it cause car accidents you don’t usually get jake out of…. Trust me i know been there done that and it was more of a pain then anything

SINCE IT WASN’T YOUR FAULT, THE OTHERS PARTY INSURANCE SHOULD PAY FOR YOUR MEDICAL BILLS .
LETS SAY THEY HAVE ONLY LIABILITY THAT IS ENOUGH BECAUSE IF THEY HAVE ONE PERSON INJURED THEIR POLICY WILL PAY UP TO THE LIMIT OF THE POLICY IF IT WAS MORE THAN ONE PERSON THEN WILL PAY UP TO THE SECOND LIMIT. IF THEY DIDN’T HAVE INSURANCE THEN YOUR OWN POLICY WILL PAY FOR MEDICAL BILLS UP TO THE LIMIT YOU HAD CHOSEN.
ITS UP TO YOU TO HAVE A LAWYER BUT IF YOU HAVE INSURANCE THEN YOUR COMPANY HAS THE OBLIGATION TO HELP YOU . CALL THEM FIRST AND LET THEM EXPLAIN YOUR OPTIONS.
